These Terms of Use (“Terms”) govern your access to and use of the website at thecontinentalcigarclubs.com (the “Site”) and the services provided by The Continental Cigar Club (“we,” “us,” or “the Club”). By using the Site, applying for membership, or accessing the premises, you agree to these Terms.
1. Acceptance of Terms
By accessing the Site or any of our services, you confirm that you are at least 25 years of age and you accept these Terms in full. If you do not agree, please do not use the Site or our services.
2. Use of the Site
You agree to use the Site only for lawful purposes and in a manner that does not infringe on the rights of, restrict, or inhibit anyone else's use and enjoyment of the Site. Prohibited conduct includes:
- Attempting to gain unauthorized access to any part of the Site or related systems
- Using the Site to transmit harmful code, spam, or malware
- Scraping, copying, or reproducing Site content without written permission
- Misrepresenting your identity in any application or communication
3. Membership Terms
Membership in The Continental Cigar Club is offered by application and at the sole discretion of the Club. Submission of a membership application does not guarantee acceptance. The Club reserves the right to accept or decline any application.
All members agree to abide by the Club's House Rules and any additional policies issued by management. Annual dues are non-refundable except as expressly provided in the membership agreement. Membership privileges are personal to the member and are not transferable without written consent of the Club.
4. Intellectual Property
All content on the Site — including text, images, the Continental logo, the Latin motto “Factum in omni agro,” photography, and original copy — is the property of The Continental Cigar Club or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our prior written permission.
5. User Submissions
If you submit information through any application, contact form, or other interactive feature on the Site, you represent that the information is accurate and that you have the right to submit it. You grant us a non-exclusive license to use the submission for the purposes of evaluating your application, providing services, and communicating with you. We will not use your submission for marketing without your consent.
6. SMS & Communications
Where you opt in to receive SMS text messages, your use is also subject to our Privacy Policy. SMS consent is required, and phone numbers will never be shared with any third party or affiliate for marketing purposes. You may opt out at any time by replying STOP.
7. Disclaimers
The Site and our services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
The Club is a private establishment for adults aged 21 and older. Tobacco products are not safe and are intended for adult consumption only. Nothing on the Site is intended as medical, legal, or financial advice.
8. Limitation of Liability
To the fullest extent permitted by law, The Continental Cigar Club, its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or services, including any claim arising from membership, attendance at Club events, or use of the premises.
Our total liability for any claim arising under these Terms is limited to the amount you have paid to the Club in dues during the twelve months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless The Continental Cigar Club, its founders, employees, and affiliates from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your use of the Site or services, or your conduct on Club premises.
10. Modifications
We may modify these Terms at any time by posting the revised Terms on the Site. The “Last Updated” date reflects the most recent revision. Material changes affecting members will be communicated directly when appropriate. Continued use of the Site after changes constitutes your acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of the State of Mississippi, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Hinds County, Mississippi.
